Terms and Conditions for jomVELO

Welcome to jomVELO! By booking a tour, using our services, or accessing our website, you agree to these Terms and Conditions. Please read them carefully. If you do not agree to any of these terms, you must not proceed with booking or using our services.

 

1. General Terms

 

• These Terms and Conditions govern all services provided by jomVELO, including but not limited to cycling tours, rentals, and related activities.

• By booking a tour or using our services, you confirm that you are at least 18 years of age or have the consent of a legal guardian.

 

2. Booking and Payments

 

• Deposit: A non-refundable deposit of 15% is required to secure your booking.

• Final Payment: The remaining balance is due 120 days before the tour start date.

 

3. Cancellation Policy

 

We understand that plans can change. Our cancellation policy ensures fairness and clarity:

• Deposits: Non-refundable and non-transferable.

• Cancellations:

• Between 105 and 90 days before departure: Full credit of the balance (excluding the deposit) will be provided for a future trip, usable within two years.

• Between 90 and 75 days before departure: 50% credit of the balance (excluding the deposit) will be provided for a future trip, usable within two years.

• Fewer than 75 days before departure: No credit will be applied.

 

We strongly recommend purchasing travel insurance to safeguard against unforeseen cancellations.

 

4. Tour Participation

 

• Participants must ensure they are physically and medically fit to join our tours. It is your responsibility to consult a physician if you are uncertain about your fitness level.

• All participants are required to wear a helmet and comply with road safety laws and the guidance of our tour leaders.

• You must disclose any medical conditions or special requirements at the time of booking.

 

5. Assumption of Risk and Waiver of Liability

 

• Cycling tours inherently involve risks, including but not limited to accidents, physical injuries, and property damage.

• By participating in a jomVELO tour, you acknowledge and accept these risks.

• jomVELO shall not be held liable for any injuries, damages, losses, or accidents that may occur during a tour, including those caused by other participants, third parties, or external factors beyond our control.

• You agree to indemnify and hold jomVELO harmless from any claims, liabilities, or expenses arising from your participation in a tour.

 

6. Insurance

 

• jomVELO does not provide personal accident or travel insurance as part of its services.

• We strongly recommend that all participants arrange for their own insurance to cover accidents, injuries, and other unforeseen incidents during the tour.

 

7. Changes to Bookings

 

• Participant-Initiated Changes: Requests to change your booking (e.g., rescheduling to a different date) must be made in writing. Approval is subject to availability and may incur additional fees.

• jomVELO-Initiated Changes: We reserve the right to make minor changes to the tour itinerary as necessary. Participants will be informed promptly of any significant changes.

 

8. Force Majeure

 

jomVELO is not liable for any cancellations, delays, or alterations resulting from events beyond our reasonable control, including but not limited to natural disasters, pandemics, or governmental actions.

 

9. Use of Personal Data

 

• By booking a tour or using our services, you agree to our Privacy Policy.

• jomVELO reserves the right to use your contact details for marketing purposes, including promotions and special offers, directly from jomVELO or on behalf of our partners. You may opt out of such communications at any time.

 

10. Governing Law

 

• These Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia. Any disputes shall be subject to the exclusive jurisdiction of the courts in Malaysia.

 

11. Severability

 

• If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

 

12. Acceptance of Terms

 

By completing a booking with jomVELO, you agree to these Terms and Conditions. It is your responsibility to review them prior to booking.
